Section 242
Procedure to fill the bago
(1) According to the decision, if the party receiving the bado payment is on the date according to section 235, the court shall file a document on whether such party wants to take the bado payment or not.
(2) If the party who is entitled to take the wrongdoing does not want to take the wrongdoing when the document is filed according to sub-section (1), the court shall end the matter related to the execution of the judgment on the same day and close the wrongdoing.
(3) If the person who is to receive the payment of bado during the documenting according to subsection (1) wants to receive the bado payment and the party giving the bado payment is on the date, the court shall give him a maximum of thirty-five days to pay the bado to be paid according to the judgment.
(4) Within the time given under sub-section (3), the party paying the default shall deposit the amount in the court in cash, good for payment check issued by the bank or any other means.
(5) Notwithstanding anything written in sub-section (4), the defaulting party may request the court to recover the amount due from any of his assets.
(6) If the party paying the debt does not appear in court, or if he pays the amount for the debt within the time specified in sub-section (3), if he does not show the property according to subsection (5) or if it is not possible to pay the debt from the property so shown, and if the party receiving the debt does not agree, then the party receiving the debt shall pay the debt to the other party. He can show the property and file an application before the court to get compensation from such property.
(7) According to this section, if any property has to be withheld while recovering the debt, the court shall, after retaining such property, auction the property and pay the debt.
(8) According to sub-section (7), if the amount received at the auction of the property is more than what was intended, the court shall return the amount immediately if the party involved in the misappropriation is present.
(9) If the concerned party fails to pay the amount according to sub-section (8), the court shall deposit such amount in the bond account.
(1o) The concerned person within one year of depositing the amount in the bond account as per sub-section (9).If they do not come to collect the amount, such amount will be tied to the government income.
(11) If the property to be paid is located in another district, the court shall send a written notice to the relevant court to pay the bill.
(12) If written according to sub-section (11), the concerned court shall also fill the form according to this section and give the information to such court.
(13) Notwithstanding anything else written in this section, if the person who receives the bego is found to have hidden the property from the person who has to pay the bego and brings it while he is still alive, the court shall auction such property and pay the amount up to the bego received by him.
(14) According to this section, the court shall collect three percent of the fee from the person receiving the fee.
(15) According to this section, in relation to the payment of a person's debt, if the party who needs to pay the debt in whole or in part files a bank guarantee letter from a commercial bank and submits it in installments, the court may grant such debt payment in installments if the related party agrees to pay the debt.
